Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FreelancerAutoBid (the “Service”), including our website, customer dashboard, APIs, and FreelancerAutoBid for Google Chrome. By creating an account, subscribing, installing FreelancerAutoBid, or otherwise using the Service, you agree to these Terms and our Privacy Policy and Cookie Policy.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

FreelancerAutoBid provides software—including cloud configuration, AI-assisted proposal generation, bid tracking, and related features delivered through FreelancerAutoBid for Google Chrome and a web dashboard—intended to help users work more efficiently on third-party freelance marketplaces. The Service does not replace your judgment; you are responsible for your activity on any marketplace and for complying with that marketplace's rules.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Access to paid features requires an active subscription or trial where offered. Fees, billing cycles, trials, renewals, taxes, and refunds are presented at checkout or in your account and processed by our payment partner (e.g. Razorpay). You authorize us and our payment partner to charge your chosen payment method according to the plan you select.

You may cancel according to the cancellation flow we provide; cancellation typically stops future renewals but does not necessarily refund past charges unless required by law or stated in an offer. We may change prices or plans with reasonable notice where required.

You agree not to:

• Use the Service in violation of applicable law or third-party rights
• Attempt to gain unauthorized access to our systems, other users' data, or the Service's internals
• Reverse engineer, scrape, or overload the Service except as permitted by law
• Use the Service to distribute malware, spam, or deceptive content
• Misrepresent your identity or affiliation, or use the Service to manipulate marketplaces fraudulently
• Resell, sublicense, or redistribute the Service without our written consent

You remain solely responsible for your conduct on Freelancer.com or any other platform, including compliance with their terms, project rules, and applicable regulations.

FreelancerAutoBid is not affiliated with, endorsed by, or sponsored by Freelancer.com or any other marketplace. Your use of third-party sites is subject to their terms and policies. We do not control and are not responsible for third-party services, project listings, or client behavior.

Outputs from AI features are generated automatically and may be inaccurate, incomplete, or unsuitable for a particular project. You must review, edit, and approve any content before submitting it on a marketplace. We do not guarantee outcomes (for example project awards or income). AI processing is described in our Privacy Policy.

We and our licensors own the Service, including software, branding, and documentation. Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable license to use the Service for your own business purposes during your subscription. You retain rights to content you submit; you grant us a license to host, process, and display that content as needed to operate the Service (including AI processing as described in our Privacy Policy).

We strive for reliable operation but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice where practicable. We may deploy updates to the FreelancerAutoBid through normal distribution channels.

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, risk to the Service or other users, or as required by law. Provisions that by nature should survive (including limitations of liability, indemnity, and governing law) will survive termination.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FREELANCERAUTOBID OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) THE AMOUNTS PAID IN THE MONTH PRECEDING THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED.

You will defend, indemnify, and hold harmless FreelancerAutoBid and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of third-party rights or marketplace rules.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, subject to mandatory consumer protections in your country of residence where they cannot be waived. Courts in India shall have exclusive jurisdiction for disputes arising from these Terms, except where local law requires otherwise.

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we will provide additional notice where appropriate. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
